Supplemental Guidance: Indirect Cost Rates

On February 7, 2025, the NIH published a new notice . This notice states that effective immediately, all NIH grants must have a maximum indirect cost rate of 15% in lieu of the normal rates defined in a university’s negotiated indirect cost rate agreement.

There is uncertainty over whether and how this policy will be implemented. This uncertainty is heightened by the emergence of legal actions in response to steps that federal agencies have taken to put into effect the recently issued Executive Orders and memoranda. On February 10, Temporary Restraining Orders were issued in two cases, Civil Action No.  and Civil Action No. , temporarily blocking the imposition of the 15% rate. On March 5, a was granted for these two cases and a third case (25-CV-10346), extending the block on the proposed reduction.

On April 11, 2025, the Department of Energy (DOE) issued , titled “Adjusting Department of Energy Grant Policy for Institutions of Higher Education (IHE),” which states that DOE will no longer use negotiated indirect rates for grants awarded to Institutions of Higher Education and all current and future awards are subject to a standardized 15% indirect cost rate. On April 16, 2025, a was granted, preventing implementation of the policy.

Guidance for Researchers

Continue work on your grant-funded research projects according to the scope of work as awarded unless you receive a notice from the funding agency advising you to pause or modify your work. Please forward any communications you receive from a program officer to Teri Kocevar.

Continue to submit proposals following the published due dates and the RFPs as published. Regularly review the RFP to which you are submitting and so you are aware of any changes made to the program or submission deadlines. Also consider reviewing executive orders and memoranda to evaluate how they align with your proposal.
